The Zakon journal in November 2014 carried a piece by senior partner Vadim Maklakov and senior lawyer Nikita Scherbakov, called "Subsequent Approval of Procedural Steps Taken by an Unauthorized Representative".
The article examined the application of the Russian Civil Code's requirements of approval for a transaction executed by a representative not vested with the respective authority to the procedural representation requirements of the Civil Procedure Code and the Arbitrazh Procedure Code.
The authors argued against the possibility of procedural steps taken by a judicial representative in court beyond the limits of their powers being approved by the claimant in retrospect.
